 At about 1:25 a.m., September 14, 1931, on patrol duty, Sergeant Timothy Murphy encountered three holdup men in a restaurant at 18 East 13th Street, Manhattan. Shots were exchanged and Sgt. Murphy was killed.

It took more than seven years to solve the killing of Sgt. Murphy, based upon information from an inmate in Dannemora Prison. Four individuals were arrested and convicted, all were sentenced to the electric chair. Subsequent appeals and reversals by appellate courts lasted until 1941. At that time the death sentences of Carl Sommerfield and Norman Brabson were commuted by Gov. Lehman, to life in prison. Joseph Feola and Albert Mastrone plead guilty to Manslaughter 1 degree during their third trial.
